Peer-to-peer Bitcoin trading is legal in Canada, and the main non-custodial options are Bisq and Hodl Hodl. Bisq is open-source desktop software that matches you with other users, never holds your funds and says it requires no identity verification. Hodl Hodl locks coins in a multisig escrow you control and also asks for no verification. Both are unregistered with Canadian securities regulators, so no Canadian investor protection applies, and you carry the counterparty risk. LocalBitcoins, the old Canadian favourite, closed in 2023.

Is Bisq Legal In Canada?

Using Bisq as an individual to buy or sell your own Bitcoin is not something I found prohibited. Bisq is software, not a company that takes custody, and it says it never holds your funds. The caution is about you, not the software. If you buy and sell regularly for profit, you may be running a business, and FINTRAC's rules for money services businesses dealing in virtual currency could apply to you. I am not a lawyer, so if you plan to trade volume, get advice. On taxes there is no ambiguity: the CRA's rules apply to every sale, whatever the venue.

How Does Bisq Work?

Bisq's own page describes trading on a global peer-to-peer network of users running the software on their own machines. You post or take an offer, and deposits are held in 2-of-2 multisig wallets so that neither side can run off with the Bitcoin before the fiat payment is confirmed. Your data is stored locally and not sent to a central server. Bisq says it needs no identity verification. Its front page does not list supported currencies or payment methods such as Interac, so you must open the software to see which offers exist for Canadian dollars. Liquidity can be thin, and the process is slower than a registered exchange.

How Does Hodl Hodl Work?

Hodl Hodl describes itself as non-custodial. The seller deposits Bitcoin from their own wallet into a multisig escrow contract, and Hodl Hodl says you control the keys to the funds in escrow. The trading fee is split between buyer and seller and deducted from the Bitcoin amount. It lists 100+ currencies and says no verification is required, only an email and password. I did not find any statement on its front page about Canada, so check its terms for current country rules before trading.

What Replaced LocalBitcoins In Canada?

LocalBitcoins announced its closure on February 9, 2023, stopped new registrations that day and suspended trading on February 16, 2023, with a year for users to withdraw. It is not an option. For Canadians who used it for cash trades or for coins delivered to their own wallet, the practical replacements are three. Bisq and Hodl Hodl are the closest in spirit. Bull Bitcoin sends Bitcoin to your own wallet, with Interac e-Transfer, bill payment and wire funding. Bitcoin Well offers online buys with a 1.5% spread and ATM and voucher options. What Are The Risks Of Peer-To-Peer Bitcoin Trading?

  • Counterparty fraud. The other side may claim they paid and did not, or pay with a stolen account.
  • Payment reversal. Interac e-Transfers sent to or from strangers can be flagged by banks. See can Canadian banks block crypto purchases.
  • No safety net. No CSA registration, no CIPF and no regulator to call. The Canadian Anti-Fraud Centre warns that crypto payments lack credit card style protection.
  • Dirty coins. If a counterparty used coins from a crime, you can be pulled into an investigation.
  • Your own mistakes. A self-custody wallet means lost keys are lost coins.

Is Peer-To-Peer Cheaper Than An Exchange?

Not necessarily. Hodl Hodl takes a fee, Bisq trades involve network fees and security deposits, and buyers often pay a premium to sellers. I could not verify current fee schedules for either platform, so I will not publish numbers. Compare against published rates on registered platforms: NDAX charges 0.20% flat, Wealthsimple 0.5% plus spread, and Bitcoin Well a 1.5% spread online. If privacy is your reason, my honest view is that most Canadians are better served by a non-custodial purchase from Bull Bitcoin, which still follows Canadian rules, than by a stranger on the internet.

How Do You Stay Safe If You Trade Peer To Peer?

  1. Start small. Make your first trade a test amount.
  2. Use escrow and read the contract. Never release coins outside it.
  3. Check the counterparty's history. Prefer traders with many completed deals.
  4. Use only your own bank account. Third-party payments are a red flag.
  5. Send coins to a wallet you control. See cold storage in Canada.
  6. Keep records for the CRA. Every sale is reportable, as covered in how crypto is taxed in Canada.

Both cost real money, around 1.5% to 2% per side, and both ask who you are. In exchange you get a named company, Canadian bank rails and a path to a regulator. That is the trade against peer to peer: a few percent for fewer ways to be robbed.

What Does Canadian Law Say About Anonymous Bitcoin?

Owning Bitcoin is legal. Hiding where money came from is not. FINTRAC's guidance requires money services businesses to verify identity at $1,000 for virtual currency exchanges or transfers, and to report receipts of $10,000 or more. Laundering proceeds of crime under section 462.31 of the Criminal Code carries up to 10 years on indictment. A peer-to-peer trade where you know your counterparty is paying with stolen money is therefore a risk to you, not only to them. Should You Meet A Buyer Or Seller In Person?

My advice is not to, unless the amount is small and the meeting is somewhere public and monitored. Carrying large amounts of cash to meet a stranger is how robberies happen, and a rushed handover is where fake notes and last-minute changes appear. Escrow-based trading online avoids this, and a regulated route such as Bull Bitcoin avoids it entirely. If a trade partner insists on moving off the platform's escrow, walk away.

Can Peer-To-Peer Trading Replace An Exchange?

For most Canadians, no. It is slower, thinner and riskier, and it still leaves you with tax records to keep. It makes sense as a complement for people who value privacy and are willing to accept counterparty risk. If you are new to Bitcoin, start on a regulated platform and learn the basics first.
