Is Self-Custody Legal In Canada?
I found no Canadian rule that prohibits holding crypto in a wallet you control. The registration regime from the CSA applies to platforms that trade or hold crypto for others, which is why exchanges list their legal entities and categories. Holding your own keys does not make you a platform. Your tax duties are the same either way: selling, trading or spending is reportable, and a transfer between wallets you own is not. How Do You Set Up Cold Storage Safely?
- Buy direct from the manufacturer. The Canadian Anti-Fraud Centre warns buyers to get hardware wallets from the manufacturer. A pre-initialized wallet from a marketplace is a classic scam.
- Check the packaging and firmware. Follow the maker's verification steps.
- Generate the seed on the device itself. Never type a seed into a computer or phone.
- Write the recovery phrase on paper first, then on metal. Metal plates such as Cryptosteel and Billfodl survive fire and water in ways paper does not. I have not tested them, so check the maker's own specifications.
- Send a small test amount. Then restore the wallet from the backup to prove the backup works.
- Move the rest. Send from your exchange in stages.
- Store the backup apart from the device. Two locations, neither the same as the device.
Should You Use A Bank Safe Deposit Box For Your Backup?
A safe deposit box is a reasonable place for a metal backup, but know what it is not. CDIC deposit insurance does not cover cryptocurrencies, and I could not verify from CDIC whether safe deposit box contents are covered by anything, so ask your bank in writing what its liability is. Also check who can open the box if you die, because a bank may need court paperwork before it releases contents. A fireproof home safe and a trusted second location are alternatives. What matters is that no single fire, flood or theft can destroy both the device and the backup.
How Do You Plan For Your Estate With Bitcoin?
This is where self-custody fails most often. The CRA says that when someone dies, capital property is deemed to be disposed of immediately before death at fair market value, and any gain is reported on the final return. Your executor therefore needs to know the coins exist and to value them. Practical steps:
- Keep a plain list of what you own and where the devices and backups are.
- Tell your executor how to find the instructions, but do not write the seed phrase itself in a document that many people will read. Ask a lawyer how to store it.
- Consider multisig, so no single backup is enough to take the coins.
- Talk to a lawyer about wording for digital assets.
How Do You Move Coins To Cold Storage Without A Tax Event?
Send them from your exchange to your own wallet address. The CRA does not treat a transfer between wallets you control as a disposition. Keep the transaction ID, the date and both addresses so you can prove it later. Network fees are paid in coins, so keep those records too. Your tax records should show it. If someone finds your backup, they still cannot reach the coins without it, but if you forget the passphrase, nobody can recover them, including you. It is also harder to set up and to explain to an executor. Most people holding a few thousand dollars do fine with one hardware wallet and a good backup. Add these layers when the amount justifies the complexity.
