Yes, Bitcoin mining is legal in Canada, but getting power for it is not simple. No federal or provincial law bans mining outright. The restrictions come through electricity: British Columbia permanently stopped new mining connections to BC Hydro in fall 2025, Manitoba has a moratorium and passed new legislation in June 2026, and Quebec requires ministerial authorization for operations of 50 kW or more.

A small rig in your own home usually needs no approval, but you still pay for the power, and the CRA says mining is generally a business.

Is Crypto Mining Legal In Canada?

Yes. Nothing in federal law makes it illegal to run mining hardware, and provinces regulate the electricity, not the hashing. That is why the practical answer changes by postal code. A hobby miner with a few machines in a house in Ontario has a different life from someone trying to connect 10 megawatts in BC.

Where Is Bitcoin Mining Banned Or Restricted In Canada?

British Columbia

The province's government paused new connection requests for crypto mining in December 2022. It later made the block permanent through the Cryptocurrency Power Regulation, which, in the province's words, permanently relieved BC Hydro of its obligation to serve certain new cryptocurrency operations. The ban applies to new connections going forward. The province's page does not address existing customers, so do not read it as a ban on every miner.

Manitoba

Manitoba kept a pause on new mining connections, and in 2026 its legislature passed the Manitoba Hydro Amendment Act, which enables a curtailable power program, meaning the utility can cut power at peak times. A separate bill sets a levy on electricity supplied to crypto operations. If you are looking at a Manitoba site, you are looking at a moratorium with rate and curtailment risk on top.

Quebec

Quebec has the cheap hydro that attracted miners, and it now controls who gets it. Any request for at least 50 kW of power for cryptographic use needs authorization from the Minister of Economy, Innovation and Energy before the connection, and Hydro-Quebec applies a dedicated rate to those contracts. Plan for it to be slow and uncertain.

Alberta, Saskatchewan And The Rest

Alberta's deregulated market is where many large operations settled, though a power plant there can need Alberta Utilities Commission approval, and any new energy-intensive customer in Saskatchewan needs the utility's sign-off first. I have not re-verified these provinces' detailed rules this month, so use my notes as a starting list for questions to ask the utility, not as legal advice. If a site sits on First Nations reserve land, federal and First Nations rules apply rather than provincial ones.

How Is Crypto Mining Taxed In Canada?

The CRA says mining is, in most cases, carrying on a business, so the value of the coins you receive is business income when you earn it, reported on form T2125. You can deduct business expenses such as electricity, and mining rigs such as ASIC miners and GPUs can fall under capital cost allowance class 50. Selling the mined coins later creates a capital gain or loss measured from that earned value. What Are The Alternatives To Mining At Home?

For most Canadians, buying Bitcoin is cheaper and simpler than mining it. A registered exchange takes a published fee, and you skip power, noise, heat and the tax paperwork of a business. How Do You Check Your Province's Rules Before Buying Hardware?

  1. Ask your utility in writing. Describe the load in kilowatts and ask whether a crypto or large-load rate applies. In Quebec, anything at or above 50 kW needs ministerial authorization before connection.
  2. Check municipal zoning and insurance. Noise, heat and electrical load can breach local bylaws or void a home policy.
  3. Price the power per kilowatt hour. Hydro-Quebec has proposed a rate of 19.5 cents per kWh for blockchain cryptographic use, with a three-year transition for current customers and a Regie de l'energie hearing this fall, according to BLG's July 2026 note on data centre regulation in Quebec.
  4. Plan the tax. Treat mining as a business from day one, with records of every reward and its Canadian-dollar value.
  5. Check again before you buy. Rules in this area changed in 2022, 2025 and 2026.

What Are Canadian-Origin Miners Doing Now?

The large listed miners with Canadian roots are shifting toward data centres and moving their head offices south. Keel Infrastructure, formerly Bitfarms, redomiciled to the United States on April 1, 2026 and describes itself as a digital infrastructure and energy company building data centres for high-performance computing and AI, with Bitcoin mining as the legacy business and sites in Pennsylvania, Washington State and Quebec. Hut 8 is headquartered in Miami and operates 19 sites across North America. Both examples show that for large operators the question is no longer only "where is power cheap" but also "where can I get a contract for AI workloads." Is Mining Still Worth It For An Individual?

For most individuals, the maths is hard. You compete with industrial operators who buy power at scale. The Bitcoin halving on April 20, 2024 cut the block reward from 6.25 to 3.125 BTC, with the next halving expected around 2028, according to CoinLedger's halving page. A home miner needs cheap or free electricity, a place to put the heat and the discipline to treat it as a business for tax. If you only want Bitcoin exposure, buying it is far simpler and has no hardware to depreciate.

Can You Host Your Miners With A Company Instead?

Hosting moves the power problem to someone else, and it is common. Hut 8 lists hosting and managed services among its business segments, alongside self-mining and data centres. That does not remove tax: if the miners are yours, the rewards are still your business income in the CRA's view, and the hosting fee is an expense. Read the contract carefully for who bears power-price changes and curtailment, since Manitoba's new law makes curtailment a live risk.
